by admin on February 17, 2011

Some good news from Mr. Ted Frank at the Center for Class Action Fairness.

Synopsis

Center for Class Action Fairness has confirmed that it will be representing a number of HP class members.

What does this mean?

Center for Class Action Fairness will be filing papers with the court on behalf of its clients this month asking for the court to enforce the settlement with respect to all HP class members and to extend the claims deadline for HP class members.

What does this NOT mean?

* Center for Class Action Fairness CANNOT give individual advice to individual HP owners

* Center for Class Action Fairness attempt may or may not be successful

* Center for Class Action Fairness WILL NOT be signing additional clients at this time

What can YOU do to help?

* You may be asked to complete a declaration (a simple form stating your machine’s spec and your displeasure about the current proposal replacement, but you must sign it under oath – more info on this later)

* Continue to contact the consumer affairs division from your State Attorney General’s Office

March 28th hearing (that’s tomorrow) is when Ted Frank will make his case to Judge Ware.

Yes this information is somewhat comforting. I’d hate to think that all HP members would receive a CHEAP inferior model to replace a higher end Entertainment unit that cost quite a bit more.

Today I have received CQ56-115DX which is a very basic model (around $300 model, less functionality). Diffcult to operate. I had mine which I had baught for $900. Very much disappointed by NIVIDIA’s replacement. I would like to support to get the exact replacement.

I received my CQ56-115DX replacement computer and after one day of having it up and running it shuts down on it’s own and will not come back up right away. This is such bullsh*t that my $1,400.00 HP Entertainment Laptop was replaced with this piece of crap. Who do we need to turn to that will help us take care of getting what was comparable to what we had or to get one that actually works?

Kim June 28, 2011 at 12:40 pm

It now only starts up but nothing will come up on the screen. My husband has ran scan after scan on it and nothing. Is there something we can do or someone we can call about this?

I’ve been waiting 12 weeks for my inferior replacement. Called today and was told that it would ship on July 27! That makes it over 3 months. Has anyone actually received their replacement?

Can anyone tell me who has received their computer who the shipper is? and if there is a telephone number. My replacement computer was shipped to my home – of course with no prior notice that it was coming, and it was stolen from my doorfront. (I know, dummy, I signed the door tag thinking it was some dumb celphone covers and screen protectors I had ordered from Verizon!) Now, Fedex isn’t responsible because I signed the doortag, the Administrator for the lawsuit isnt’ responsible, and they claim they have NO INFORMATION on who is doing the actual shipping of the computers, so I can try to file a claim on insurance…Can anyone help???

I have received CQ56-115DX which is a very basic model , which has far less functionality them my HP Pavilion DV6448 Entertainment notebook. I am very much disappointed by NIVIDIA’s replacement. I don’t understand how NVIDIA can state that you will recieve a comparable PC but sends everyone the same model regardless of what your original PC cost. I would like to support to get the exact replacement or a replacement that has the same functions, ie. webcam DVD burner and lightscripe. The results of this class action suite speaks for HP, Dell etc. They should care more about there customers also. I bought 3 HP laptops, 3 desktop computers and 2 HP printers. If the contract they have with NVIDIA is what they feel is justice they to are full of crap.

I rec’d the replacement CQ56 today. I returned the original computer March 18. 2011. I was happy with my original computer for 10 months until it started breaking down more often than it worked. HP repaired it once. HP never informed me of the Nvidia problem.
I will not purchase another HP computer or printer again to prevent myself from having nightmares.

I had a dual-core, and am VERY worried this POS that will? come NEXT MONTH (AUG.) will not do what I used to… It makes sense that with
the second class treatment we all got that the second class computer would come 15 weeks later instead of the normal order time for HP.
I’d like to find out what normal order time is.

I’ve had my replacement Compaq for a week and I’m very happy with the Presario CQ-56; I must add that I returned a “POS” Compaq Presario F572US, so the CQ-56 is actually an upgrade from my defective F572US.

I do feel sorry for the guys returning high-end laptops and getting a replacement that barely plays Pong & even MS Solitaire is a challenge & overwhelming for the CQ-56′s CPU…

Better than nothing guys; and are you REALLY that shocked by the Lawyers; come on, they’re Lawyers…

I am at 19 weeks since my claim computer was ordered and nothing is in sight yet. Like everyone else, the replacement is half or less of the value/features of the machine I had. That machine was a piece of junk from the beginning, with first, the battery failing, then the wireless and finally the display. I’ve been without it for about a year now and been vastly inconvenienced by their poor craftsmanship and lack of integrity.

Are we being fobbed off? Oh yeah. They are sending some cheap small featureless model at their leisure, which is being manufactured somewhere in the world, not in the United States. Hense the long wait for shipping.

There is one thing we can all do easily. Just tell your story at every opportunity. Let people know what Nvidia and Hewlett Packard did and how you were treated. Urge people to think it out for themselves before they purchase products. Pass the word that these comapnies are using their size clout to disrespect consumers. Put it plainly…don’t buy from them and urge others to buy other brands.

I received the Asus Eee Tablet in exchange for my $1,500 HP tx1320us that was a tablet with DVD-RW, Lightscribe, Remote control, built in stylus, etc. Plus, I bought the HP TV Tuner, Docking Station and numerous other accessories that became obsolete after it died 13 months in (with a 1 year warranty). The Asus is a piece of junk with NO CD or DVD drive!!! It’s basically ONLY a Netbook. There is little to NO software built-in. NO MICROSOFT OFFICE!!!! It’s a Windows 7 which is not compatible with most of the software I have. Even if it was, there is no CD DRIVE to install it!!! What a scam!!!

I just received my (2) yep (2) pieces of crap in replacement for my (2) high end HP’s, DV2000 and DV90000. Total cost new for both was $2800, I see that these Compaq POS’s are available for less than $300 all over the web.

I will never buy HP or anything with NVIDIA ever again. Scumbag companies.

The CQ56-115DX as shipped for the settlement is so slow as to be almost unusable. I am considering replacing the 64-bit Win 7 OS with a 32-bit copy of XP Home that I still have (that or Ubuntu), as it will likely do better with the low-power processor and only 2 GB RAM in the laptop. As it is, I gave the laptop to my young daughter, as it is useless for me.

I got my CQ56-115DX two days ago, and like others not impressed so far. . .

the touch pad sucks and the cpu is slow i guess i’ll just have to deal with it.

I received mine back in June. My original laptop was a mid range media model at $700 so this one operates at about the same processor speed. Windows 7 is much more efficient than Vista so overall performance is slightly better.
I’m now lacking the touch sensitive keys across the top, no IR remote capability, no media card reader, no express card port, no firewire and no TV output. Battery life is NOT impressive. I bought an expensive high capacity battery for my old Presario and of course this new model’s battery is slight different making it useless.
On the other hand the CQ has twice the memory (and faster) and 3X the HD space. Keyboard is surprisingly nice and the sound is excellent. Considering it replaced a computer with 4 years of extensive use, it’s pretty much a wash for me. If I had bought a $1400 model I’d be pissed.
I bought a VGA to TV output adapter and use it as a portable Netflix player for various TVs around the house.

After sending out my old laptop I bought a Toshiba for $375 on sale at Staples. Dual core, 500 GB HD, 4 GB ram, HDMI out, card reader, SATA port, webcam, number pad, etc. The CQ is painfully slow compared to the Toshiba. Battery also lasts twice as long.

I think if something like the very inexpensive Toshiba was sent out, there would be no complaints.

>> “I think if something like the very inexpensive Toshiba was sent out, there would be no complaints.”

Then people would not like something about the Toshiba.
In April/May I went to BestBuy and saw this exact CQ56…,
the same priced Toshiba sitting next to it was lower rated and slower.
There were better models in the CQ56 series that would be a LOT
closer to what I had.
Mine came recently, and it surfs well. It was between 74 and 90
WINDOWS7 patches behind. It failed numerous times to install them.
I had to break down the batches to one, two or ten (after I got tired…)
SP1 has NOT embedded, and was added almost last.
(I let Windows-Update do everything it wanted, at first…….)

I posititively HATED the touch-pad buttons. They are designed like a
see-saw with no break in the middle, (use the extreme outside
edges). AND they are perfectly flush with the surrounding surface
and hard to feel or find. I happened to have some strips of “egrip” and
put them on the touch-pad buttons so I could find the corners easier.
(No relation to that company, I got some of their discontinued stock
for a different reason, cheap.)
I’m going to turn this into my computer that is *on* the most, and see if it lasts a year. Even the “old defective NIVIDA” one did better than that, TWICE. (It was factory rebuilt once free.)
If this one does NOT make it a full year, I’m going to consider I got screwed again and the defective one might have almost made that again.
It was having minor video problems ON BLUE SCREENS again that scared me though…

Mine came. Other than having to replace my “Express Card” TV card
with a cheap knock-off, all is well. I’ll hold the low features/quality of
this against Nivida “forever”.
IT is something I would HAVE NEVER bought, and I’m not too fussy
or lean towards “high end” stuff.
I got away from being a “bottom feeder” a few years ago.
Cheap is cheap. There is no getting around that…

And if the HP/(ATI) does not hold up at least 3 years they will gain
a place on that list also. (My oldest Laptop is still running Win3.1,
ATT made stuff that lasts.)

IMHO, They pixxed off a lot of people by NOT putting at least a 1.6G
Dual core in here.
And saying we all need to get a bunch of external accessories (like card
readers, etc) on the cheap and a special bag to carry them in just shows
how clueless the “expert” and the Judge were.
The thing is still generally only accepting Windows patches “one at a
time”. (At least they go in…)
Soon, I’ll clone the NEW HD (250G) to the one I took out of my replaced
machine (it is a pretty new 500G).
I’ll see if there are any “early failures” first, so they can’t say I screwed
it up.

Seems like everyone moved on… I’m so thrilled with my wonderful
“replacement” (note: sarcasm) I’m lucky if I turn it on twice a month
to get updates from MS and others. I only use it occasionally for
recording TV as I have moved back to depending on Desktops.
They CAN be fixed, and you are not held hostage there.
Just hostage to a fixed location… ;-(

And about holding this against HP? Seems like they are sick of all this too.
They want to get out of selling to normal users.

This will most likely get deleted as many of my other posts but will ty to post anyway.

I intend to pursue this matter all the way to the top. I will not stop until I get a result.

It’s been quite some time since I’ve heard anything about this case or my replacement.

I’ve spoke with several different people from the useless Millberg to the even more usless company fielding our calls with no straight answer to any of my DIRECT questions.

I have two law offices at this point that are willing to take on this situation. I can only assume that they see this whole charade in a different light.

One office is halfway across the country. Guess I need to load up my camper. =) Meh… vacation!

Hello!

I need to hear from as many of you as possible. I would like your story and feelings on how this settlement was and is being handled.

Please, please contact me with your story and feelings.

P.S. I need no personal information. Just your honest feelings and a background on what you bought and what supposedly they are replacing your failed computer with. Also dates of when you sent your faulty equipment in and when you received your replacement -provided you’ve gotten your replacement.

Wow, my replacement Asus netbook made it 9 whole days before the touch surface started to fail. Awaiting RMA info. (I really thought the Asus would have been better then then Compaq.) Hope the lack of a receipt will not messs things up. So far it has not. I was surprised that it arrived on a Saturday, but other than that, I am not impressed. It’s an OK netbook, but Windows 7 Starter essentially cripples the touch features. Home Premium should have been the OS shipped with these as that was what my tx1320 had. Lost a lot of features with this ‘replacement’

HP actually called me when I wrothe the President of the company how I felt they mishandled this when Apple & Dell actually stood behind thier customers and fixed their computers. I have never experienced a company who so totally washed their hands of a defective product. They told me flat out nVidia has taken reponsibility for this, and my response was that nVidia’s name is not on the lid, HP’s is and he did not come up with a good answer. nVidia’s chip did not just magically appear inside HP’s laptop. My metaphor to him is that when a car has a defective part, drivers do not go after the vendor, they go to the carmaker to solve the problem. Only thing they offered was a discount on a repair. I really could not believe what I was hearing.

I thought the replacement would make things better. Now I am even more bitter!

Just saw on CDW’s site that the Asus netbook was discontinued on August 26th. Not sure if that was just CDW, but discontinued usually means they are no longer in production. Have all of the replacements been shipped or is there a chance a few out there might, maybe, possibly get something a little bit better?

I’m SURE the settlement people got their order in on time.

I DID bump my Craptop up to max RAM… At least the 64bit OS allowed that…
(I will not touch the HD until warranty is over…)

Looks like the Asus is going back to the repair shop AGAIN for another failing touchscreen. Even though I don’t use it much, I would like it to work when I need to use it. Anybody else have such touchscreen issues?

To those that want to try and ‘improve’ their Asus: Getting the hard drive out won’t be easy and it will void the warranty. In my research on that very idea, it looks like several replaced the drive with as SSD and while they had it open, added the bluetooth module strangely lacking in the US models. It is easily found on ebay for $10 or less and just plugs right into the socket made for it on the system board freeing up a USB port. I will post the website with all of this info first chance I get.

Despite having registered for the class action, I NEVER received notice that the settlement had been approved. It has been almost 2 years since the date of approval. They must have run out of money. I should have responded quicker. Anyone need a cheap, oversized coaster?
