Interestingly, I fall into a third category you did not list: One who filed a claim, received the return authorization paperwork but have not yet mailed in my two eligible laptops — both of which are Dual core — because I just became aware of the sneaky tiki switcheroo of replacement units. When I initially learned of the settlement in mid January, the online site FAQ stated they’d be giving us Compaq CQ50′s, which had Turion X2 processors that seemed somewhat fair. The lame el cheapo CQ62 they now are offering is an insult. This is why I am hesitant to send them back now, and am hoping your yeoman efforts yield a better replacement alternative.

In addition, when I tried to fill out your form, I ran into a couple of glitches. There was no blank area in which to fill in the required product number. Also, the field for serial number did not allow me to enter the final digit/letter appearing on the bottom sticker of my laptop. Please look into this. Thanks so much for all of your efforts on our behalf!

I agree with a lot of people who are complaining about the replacement models. I am one of them, as at the time of purchase my HP Pavilion tx1000z CTO NB cost me: $1482.97 and that was with $300 discount coupon. My NB specs are:

I do take into consideration that this laptop was purchased almost 4 years ago. Even so, I would still rather keep this Computer over the p.o.s. (like Brian Beatty called it) they are offering as the replacement!!! How is this fair in any way? No matter which way you look at it, HP customers are being robbed. Are there any ways possible that I (actual customer of the product) could express my disagreement with current negotiation terms before final hearing on March 28′th?

[admin - Brian, advertising is not allowed so your URL was removed] The link is broken. I sent my laptop in for replacement. I did so because I never knew what HP was replacing them with! The Millturd attorneys did not post the replacement kind until days AFTER they opened the claims period! I would have never sent mine in for that p.o.s.

My laptop burnt up today for the second time. I paid about $400 for a repair less than a year ago. I just found this class action and found that I missed the claim form deadline by 3 days!!! I was never notificed of the class-action lawsuit, can anything be done to file a claim? I fall into two categories, one for reimbursement and replacement as this is the second time the laptop failed. Please advise me…your help is greatly appreciated! Thanks

I have an hp dv6449 pavilion laptop with vista premium that has the same problems that everyone else has been complaining about.
I was offline and bought this computer in the end of 2007 from circuit city which is out of business in ny.I had no idea about this lawsuit. what recourse do i have in this debacle? can help be anywhere for osomeone in my situation?

I just ran into the problem 3 days ago on my HP dv6436 and it took me until today to find out about the settlement.
In my defense, I was in Iraq, in a somewhat austere environment when the case got started, so I missed it all. Do I have any recourse? Is there anything I can do, or am I SOL?

I have one of the defective computers and just came across this today. I missed the deadline I still have the defective computer and original receipt. Is there anything that I can still do. I read somewhere about a March 28th date is it possible they will reopen this claim?

I filed my claim before the replacement time ran out but i was not notified about replacements or anything!!! is there any recourse for me? i got a laptop that is worth 1400 bucks and thats with a student discount!!! i am in college and i need a working laptop…i have an inspiron 1420 that is fast as craap but the graphics card is having issues…i made my claim, and i need to have it fixed a.s.a.p. like i said i need it for school, and now i am at a loss…

Same here… My video card went out a while back and falls under the category for repair. Just found this website today. I am a pc tech at a hospital and constantly read articles throughout the I.T. community. Knew nothing about this though. How the heck does the average person hear about this litigation? Dell knew my phone #, address, and phone number. I know the suits not against them but you would think someone would notify buyers of this issue. Really hope I can put a claim in after the 28th. Hello Admin,

I’m guessing there are quite a few of us that have missed the deadline for filing the claim. Most of us legitimately have reasons for missing; lack of communication, obliviousness to the actual suit, delays due to military requirements. I’ve experienced all of these. I’ve even called the call center to have them help me input my laptops information. Unfortunately I kept putting in the wrong product number. It was just today I found my correct one once I was able to finally start my laptop.

But I understand late is late.

I would just like to plead for some compassion on all of us who have failed to gain the same opportunity as all the others whom have fallen victim to this HP Nvidia situation. Could you please explain to me and all those who may inquire the significance of the 28th of March, how will that day effect us, and how can those of us who missed the deadline receive any help.

I would greatly appreciate your help.

I was one of the first people to encounter these problems with an HP tx1410, which started with the wireless-gone issue six months after purchase and with video dying one month after the warranty expired. I had a friend who had the same problem with a similar laptop and that made me suspicious, so I never paid for the $400 repair. What I did was join other people online requesting a the recall, when all HP did was deny there was any problem (in spite of the growing amount of people complaining about the same issues). I put my dead laptop in a drawer and lost track of the issue. Now I’ve found out about the class settlement, three days after the deadline to file the claim and without having ever been notified by anyone.

My laptop only stopped working a month ago, and I found the class action lawsuit just by typing the model number into Google. I mailed my clain form in person by handing it to a post office employee at the post office with a pile of mail. I had filed the claim form out online (obviously on time), but did not have electronic proof of payment so I had to mail it in. My form came back in a postage paid post office envelope, refolded to fit this new envelope, a full month later! No explanation or return address or postmark or anything!
The post office said they would have no reason to remove, re-fold, and send my mail back in a new envelope with my original envelope missing (and I believe them).
The company handling the NVIDIA claims says there is nothing they can do, since my original envelope with the post mark is missing. But every time I call they have all my claim info since I filled it out online, then printed it. I asked a supervisor why, if they had my information/serial number/model number well before the 14th, can I not just re-send the proof of payment? Obviously no one else is claiming my faulty laptop so they owe someone something! Has anyone else been experiencing similar shenanigans? I’m keeping my fingers crossed for the 28th.

I am in agreement with many others especially Fernando. My tx1000z crapped out over a year ago and when my only option then was to buy a new motherboard which might end up with the same problems I decided to buy a new computer. Now I see that there was a recall which ended just over a week ago and I’m really pissed. I never received any communication about this issue. I feel like an extension should be made for us all.

I received information about the class action suit in the mail, but it always said I need to do nothing. I kept checking back on the website, made sure my model was eligible, but every communication said that I needed to do nothing and I would be included in the claim. Now, I checked back to see the status, and saw that apparently I had to file a claim form and now I’m too late. My $1300 computer lasted 13 months.

How can those who missed this deadline for several reasons plausible and possible, push for an extension? Which I think should definitely be given

I think you guys (nvidia) should open this settlement info page on facebook it’s easier to get people and spread the word around that way.

PEOPLE…ANYONE? ANY IDEA?

Check the “BAD HP NOTEBOOKS” tab to see if your notebook is on it or now:

1. if yours is on the list, your only remedy is to wait for March 28th hearing to see what Judge Ware will say

2. if yours is NOT on the list, you are free to pursue your actions via small claims court

You could say I had a pretty bad winter. I broke my leg after moving to Minnesota and I had to have surgery and a plate inserted, missed a recent mail in rebate for a $60 phone and even more bothersome, I missed a class action settlement for two laptop with an NVidia GPU unit that I bought a couple of year ago and had been deficient (lasted about a year and a month). I have two Tx1xxx laptops and I hope there is still something I can do. I recently read the notice on the floor. My house has been a mess since I broke my leg on January 18. Is there anything I can still do? I bought a new laptop from gateway and it is also having other issues, and I may have to buy another laptop soon. I hope I can avoid this new purchase by sending my two Tx1xxx back. (I have the proofs of purchase – one was bought at Sam’s Club and the other one through HP online)

Please if there is something you can do to help. Perhaps send a late claim? I would greatly appreciate it. Is there anything I can do? Nothing I am writing here is exaggerated. I can prove any of these things. Please let me know if there is something I can do.

I received all the Fedex return info and promptly returned my dead Pavilion [edited by admin] on Feb 14 which I believe is before they posted that the replacement is going to be this crappy Compaq that’s nowhere close to spec or value. Is there any recourse? i have not received a replacement yet. I also got a call a couple of weeks back from the attorneys asking me if I was happy – I said I wasn’t and what should I do and was told ‘I am only trying to find people who are prepared to go on record that they are happy with the settlement, so I can’t help you’ and hung up!

sorry to hear your story. But I guess you can join a list of all the people. By people I mean class action affected people and not the lawyers that are taking all of the money that would’v or could’v fixed majority of those ~25,000 claimants affected machines. It’s pretty sad, that living in America, with all the laws protecting consumers against fraud and thievery and whatever else you want to call this, in reality we are nothing. Just statistics for those in fancy suits waving their fingers at courts demanding their legal fees to be covered….

So, I don’t see anywhere to sign the declaration, so please consider this my declaration:
Dear Judge Ware,
I do not believe this settlement has been conducted fairly. The computers being offered do not satisfy the like kind and/ OR value stipulation of the settlement.
Also, I attempted to file my claim online when the claim period first opened and it would not process my claim. Apparently, there was a problem in the first weeks with the tx models. After returning from overseas, I found that I could not re-file my claim because the claim period had closed, without notice. This is despite the fact that I signed up for email notifications of important dates on the settlement website. The quick closure of the claim period, even when 30% of those affected by the settlement have not yet filed a claim, is unfair! I know I speak for most of us when I say, we did not pay $1000+ for a computer from which we thought we’d get an average 18 months use. My husband has a dell computer that he purchased in 2000, which he still uses today. I at least thought I’d get 1/3 of that use from my system that costs $600 more.
Please reopen the claim period and offer replacement computers of like kind AND value. We are not greedy and are not asking for more than what we deserve. We, like everyone else, just want to get our money’s worth; we want to get what we paid for. That’s fair! That’s justice!
